USCIS Announces Registration Period for H-1B Cap
U.S. Citizenship and Immigration Services (“USCIS”) has announced that the initial registration period for the fiscal year 2023 H-1B cap will open at 12pm EST on March 1 and run through 12pm EST on March 18, 2022. During this period, prospective petitioners and representatives will be able to complete and submit their registrations via the online myUSCIS H-1B registration system. H-1B registrants and representatives may add clients to their accounts at any time, but both representatives and registrants must wait until March 1 to enter beneficiary information and submit the registration and pay the required $10 fee. H-1B registrants and representatives will be able to submit registrations for multiple beneficiaries in a single online session.
If enough H-1B registrations are received by March 18, USCIS will randomly select registrations and send selection notifications via e-mail and the online myUSCIS H-1B registration system. USCIS intends to notify account holders by March 31, 2022.
H-1B cap-subject beneficiaries must have a valid “Selected” registration notification for a petitioner or representative to properly file an H-1B cap-subject petition. Selected petitions may be filed with USCIS at any time during a 90-day period beginning April 1, 2022.
After the initial selection process has been completed, a properly submitted H-1B registration will remain eligible for selection (unless otherwise invalidated) until the end of the fiscal year, which closes on September 30, 2022. H-1B registrants and representatives will be notified via e-mail and the online myUSCIS H-1B registration system in the event a subsequent random selection has been conducted by USCIS.
