Enactment of the Employee Free Choice Act ("EFCA") is the top legislative goal of labor unions in 2009. On March 10th, EFCA was introduced in both the House of Representatives and the Senate. Whether EFCA will be enacted - either as proposed or as revised - is uncertain. If enacted, it would be the most substantial change in federal labor law since the 1930s and would expose non-unionized employers to a higher risk of unionization.
