The Department of Labor’s Plans to Expand Overtime Pay Eligibility and to Attack Misclassification of Employees as Independent Contractors (Gary Klotz and Rebecca Davies)

This Super Session will address the DOL’s Proposed Regulations Regarding Exempt Status and Guidance on Classification of Independent Contractors and will be of interest to general counsels, business owners, HR VPs and other HR executives.

Workshop Session 1

What EVERY (Even Non-Union) Employer Needs to Know About the New Union Election Rules (Craig Schwartz)

In 2015 , the National Labor Relations Board made significant changes in its election rules and procedures, which dramatically impact labor management strategies for employers attempting to maintain union-free status. This workshop will explore the changes in Board procedures and timetables, as well how those changes affect union campaign strategies. In addition, the workshop will discuss some of the major NLRB decisions which have been issued in the past year, addressing subjects such as social media, joint employment, and requirements for employee handbooks and work rules.

How to Address FMLA Abuses and Intermittent Leave Issues (Regan Dahle and Alex DeWitt)

Intermittent FMLA leave is difficult for employers to administer, and can be manipulated or abused. This workshop will examine intermittent leave and steps that employers can legally take to address FMLA abuses.

Proceed with caution - top ten takeaways for benefit plans and benefit/L&E litigation from this year’s Supreme Court decisions (including same-sex marriage) and next term’s cases.

Best Practices for Properly Completing and Retaining I-9 Form (Clara Mager and Linda Armstrong)

This panel will discuss recent trends in USICE I-9 audits, how to prepare your company for a government audit, retention requirement, in-house audits, how to properly correct I-9s that contain errors, and how to address errors that cannot be corrected. The panel will also provide an overview of the e-verify program.

Workshop Session 2

The Broadening Scope of Sex Discrimination Claims (Scott Patterson and Brett Miller)

This workshop will discuss the EEOC’s position that sexual orientation claims are viable sex discrimination claims; the implications of the Supreme Court’s same-sex marriage decision, gender stereotyping claims, gender identity and transgender issues such as the OSHA guidance on restroom facilities.

Recruiting and Retaining the Best Employees (John Hancock)

This workshop will examine and provide practical advice on methods employers can use to recruit and then retain the best employees.

Preventing and Remedying Employee Theft of Trade Secrets (Carey DeWitt and Paul Mersino)

The modern employer's most valuable asset is its intellectual property.  Addressing the all-too-common threat posed by potential and actual theft of such trade secrets and other intellectual property must therefore be a top priority for any business.  This program will explore how the theft of trade secrets can be anticipated, stopped, and remedied so that loss of employees, customers, revenue, and data do not gravely injure the business.

Hot Topics in Immigration Law: A Discussion of Recent Developments (Reggie Pacis, Bushra Malik and Elissa Pinto)

This panel will discuss recent changes impacting immigration concerns for employers with foreign workers such as new policy guidance for L-1B intracompany transferees with specialized knowledge and H-1B petition amendments for H-1B employees assigned to another work location; eligibility for work authorization for certain spouses of specialty workers; and strategies concerning the changes to the Department of State Visa Bulletin that impact the processing of “green card” cases for company sponsored employees.
