Represented a training center operating a program assisting union members to obtain personal computers. Our client purchased 5,500 computers in 2006 from a non-party to this suit. Our client paid in full for computers, which were sent to the union members. Distributor failed to pay Plaintiff. Our client had no contract with Plaintiff. Plaintiff sued distributor in 2002 under breach of contract claiming $2.8 million due. That case settled in 2005; distritutor paid Plaintiff $2.2 million. Plaintiff then sued our client in 2006 under theories of conversion (treble damages) and unjust enrichment. Our client's defense was that it never had a contract with Plaintiff and had fully paid distributor (the party with whom it had a contract). The Court denied our client's Motion for Summary disposition and the case proceeded to trial. The jury trial lasted 3 days; Plaintiff asked for $3.2 million.
