Represented a casualty insurance carrier situated in Arizona in an action against one of the largest national banks in the country. The case alleges claims for breach of contract and breach of fiduciary duty and seeks damages of $24 million.

Judge William H. Pauley of the United States District Court for the Southern District of New York recently accepted our client’s arguments and denied summary judgment to the bank. The case arises from the bank’s improvident administration of our client’s securities lending program during the 2007-08 financial crisis, and is expected to go to trial in the winter of 2011-12.
