Obtained summary judgment for our client in multiple defendant mortgage fraud case alleging RICO and other claims. Plaintiff-Lender alleged losses approaching $5 million arising from failed loans involving more than sixty mortgage transactions. Plaintiff alleged that our client was vicariously liable for the acts of its licensed, independent title agent who also served as the closing agent in each of the transactions. The Court agreed with our arguments that the alleged fraudulent activity occurred at the closing of the various transactions, which was outside the scope of the agency agreement between our client and the agent. Our client's agreement limited the agency to title activities, not closing activities. The Court held that the agent was actually the agent of the lender when performing closing activities and our client could not be responsible for the agent's closing activities as a matter of law.
