The United States Immigration and Customs Enforcement (ICE) recently launched a new initiative to dramatically expand I-9 audits. As part of that new initiative, ICE has already issued hundreds of Notices of Inspection to companies nationwide. The Notices indicate that ICE will be inspecting I-9 records in order to make sure that they are complying with employment eligibility verification laws and regulations.
The new initiative confirms ICE’s increased focus on holding employers accountable for their hiring practices. It is important to note that very substantial fines can be imposed for failure to properly obtain and have available the appropriate documents regarding employees’ eligibility to legally work in the U.S. Importantly, if the appropriate documentation is not maintained, these so-called “paper work” fines can be imposed even if all employees are legally permitted to work in the U.S.
Our discussion will focus on proper completion of the I-9; electronic storage of the I-9; common problems; USICE I-9 inspection process; and trends in investigations.
