Your employees use their health and welfare benefits on an almost daily basis, making them a highly-visible and important component of employee compensation.  At the same time, an employee’s unfavorable experience with a health plan can permanently damage an employer’s goodwill with its employees.  Our professionals have a wealth of experience in designing employee health and welfare benefit programs that are cost effective and understandable, while providing benefits that are valued by the employees that use them.  Our attorneys work closely with our clients’ human resources personnel in drafting plan related documents and in promoting effective plan administration.  We use a fiduciary best practices approach to educate our clients on how to identify and control risk of legal liability in connection with their health and welfare programs.

Experience

Advised manufacturing clients on ability to modify or terminate retiree health care benefits for union and non-union employees
Advised on large multistate welfare plan’s contracts for administering and/or insuring medical, prescription drug, life, long-term disability, short-term disability, flexible spending accounts, and employee assistance program
Assisted with termination, assignment and transition of employee benefits programs in stock sale of information technology-based subsidiary of public company, including assigning certain plans to parent and transitioning other programs to buyer.
Designed health risk assessment program that complies with ERISA, HIPAA, ADA, and GINA , integrated with employers wellness programs and incentives and determined if eligibility to participate in health plan could be contingent on completing HRA
