LOOK BEFORE YOU LEAP – THE LEGAL AND REGULATORY PITFALLS OF THE HEALTHCARE INDUSTRY:

While healthcare is a business, those looking to enter into the arena do not always appreciate the issues that come along with entrepreneurship.  Unlike starting most new businesses, healthcare entities cannot simply open shop and start charging for their services.  There are a number of complex risks and regulations to consider.  This session will discuss the legal landscape for healthcare entrepreneurs, how best to comply with enhanced oversight, and the consequences of failing to do so.

  • Overview of the Regulatory Landscape for healthcare.
  • Compliance—From the IT department to the C-suite, compliance with the regulations and laws affecting healthcare businesses is a must.  We will discuss cyber-security risks for healthcare business, and the IT department’s role, insurance considerations, and individual and enterprise liability under the DOJ’s “Yates Memo” Directive.
  • Scared straight – Case examples of fines and administrative, criminal, and civil penalties.

PANELISTS:  Deb Geroux of Butzel Long, Scott Bailey of N1 Discovery, and Catherine Bruder of Doeren Mayhew

GETTING STARTED AND BEYOND

The healthcare industry is innovating at warp speed. As you continue to compete in this quickly evolving market, it is of the utmost importance that you are ensuring you have the agreements in place to protect yourself, your ideas, and your trade secrets. Investors at all levels will be interested and concerned as to whether the intellectual property has been protected. Our panel of legal and investor industry experts will present and discuss what an entrepreneur needs to do to protect its intellectual property and what those who may invest at various levels are looking for in this regard. A mistake or a failure to take the right steps can cost an entrepreneur the opportunity to pursue its business or to advance it to another level.

PANELISTS: Paul Mersino of Butzel Long, John Beard of Butzel Long, Gretchen Perkins of Huron Capital Partners, Yusuf Hai of CIG Capital Advisors, and Fred Molnar of Michigan Economic Development Corporation (MEDC)

9:55 – 10:40 - Breakout Session 2

WHAT WORKS – WHAT DOESN’T

There are thousands of entrepreneurs with ideas for improving healthcare. How do you make your business stand out, attract investment, and become successful/profitable in a crowded industry? A panel of successful entrepreneurs, equity investors/lenders, and a corporate legal expert will discuss the key elements of creating a successful business.

PANELISTS:  Justin Klimko of Butzel Long, Andrea Dickson of ENT Biotech Solutions, Raj Kothari of Cascade Partners, and Irene Spanos of Oakland County Economic Development

THIS IS MY PROBLEM – HOW CAN YOU HELP ME?

Healthcare providers face numerous problems in delivering accessible, affordable, high-quality services to patients and customers. Can technology and entrepreneurship address these problems? In this session providers will describe some of the problems they face, and challenge entrepreneurs and developers to join the discussion on possible solutions.

PANELISTS:  Mark Lezotte of Butzel Long, George Miller of Oakland County Health and Human Services, Dottie Deremo of Deremo Consulting Group, Parag Patil of The Taubman Medical Research Institute at the University of Michigan, and Lisa Prasad of Henry Ford Health Innovation Institute

10:45 – 11:30 - Breakout Session 3

TELEMEDICINE:

Telemedicine is a broad subject covering many aspects of health care delivery. The transmission of data from one practitioner to another can be considered telemedicine. The remote diagnosis of a patient likewise is telemedicine and the interaction between a patient and a physician over a video screen in real time is telemedicine. Although there are many applications of telemedicine, what is the future? How does reimbursement work? Are patients well served through the use of telemedicine? Where can telemedicine be used most effectively? Can telemedicine solve the physician shortage? These and other pressing issues will be addressed in this session.

PANELISTS:  Robert Schwartz of Butzel Long, Kathy Jo Uecker of NetSource One, and Kevin Lasser of JEMS Telehealth

INDUSTRIAL TRANSFORMATION:

Patient expectations for care and delivery are changing.  Whether it is cost and   payment models or technology’s disruption, there is no question that today’s model isn’t your father’s healthcare industry.

  • How do we address the collection and use of data?
  • What are the benefits and concerns for integrating clinical technologies including wearables, ingestibles and implantables?
  • How will health applications and other technology impact delivery, outcomes and operational risks?
  • Will 3D printing, lightweight material research and other emerging technologies significantly impact the healthcare industry?

PANELISTS: Jennifer Dukarski of Butzel Long, Tom Kelly of Automation Alley, Marvin Al-Khafaji of Beaumont Health, Dr. Natalie Hodge of Personal Medicine Plus, and Walter Borda of Safety in Motion, Inc.
